rituart.com (the "Site") is the website of RituStudio, the studio of the painter Ritu Raj. It shows his paintings, writing and books. By using the Site you agree to these terms (the "Terms"). Please read them, and keep a copy if you wish.
Your use of the Site is also governed by the Privacy policy, which explains what we collect and why.
The paintings shown are original works. Availability can change at any time, and an enquiry is not an offer or a reservation. Prices, availability, framing, shipping and any sale are confirmed with you directly, in writing. Colours on screen differ from paint on canvas, and the dimensions given are approximate.
Visiting the Site or writing to RituStudio is electronic communication. You agree that notices and other communications we send you by email or on the Site satisfy any legal requirement that they be in writing.
RituStudio does not knowingly collect personal information from anyone under 13. If you are under 18, please use the Site with the permission of a parent or guardian.
The Site links to other websites, including artgraph.co, booksellers, galleries and social networks. RituStudio does not control them and is not responsible for their content; a link is a convenience, not an endorsement.
Everything on the Site, including the paintings, photographs, text, the ArtGraph system and the design of the Site, is the property of Ritu Raj and RituStudio and is protected by copyright and other laws. You are granted a limited, non-exclusive, revocable licence to view and use the Site for your own personal purposes.
What you may do with the images is set out in the Image licence. Beyond that, you may not copy, reproduce, publish, sell, alter or make derivative works from the content, or remove any copyright or credit notice, without written permission. The ArtGram and EncounterGraph made for each painting are the exception: they are offered under CC BY 4.0, as the Image licence explains.
You agree not to use the Site for anything unlawful, not to interfere with its operation, and not to collect its content by automated means beyond what an ordinary search engine does.
The Site is operated from Arizona, in the United States. If you use it from elsewhere, you are responsible for complying with your local laws.
You agree to indemnify, defend and hold harmless RituStudio, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. RituStudio reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with RituStudio in asserting any available defenses.
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms or any disputes arising as a result of these Terms, whether directly or indirectly, including tort claims that are a result of these Terms. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the arbitrator. This arbitration provision shall survive the termination of these Terms.
THE INFORMATION, PRODUCTS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. RITUSTUDIO AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND, AND RITUSTUDIO AND/OR ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THEM, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RITUSTUDIO AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, OR FOR ANY INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF RITUSTUDIO OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
RituStudio may, in its sole discretion, end your access to the Site or any part of it at any time, without notice. To the maximum extent permitted by law, these Terms are governed by the laws of the State of Arizona, and you consent to the exclusive jurisdiction and venue of the courts in Arizona in all disputes arising out of or relating to the use of the Site.
No joint venture, partnership, employment or agency relationship exists between you and RituStudio as a result of these Terms or your use of the Site. If any part of these Terms is found invalid or unenforceable, it will be replaced by a valid provision that most closely matches its intent, and the rest will continue in effect. These Terms are the entire agreement between you and RituStudio about the Site, and they are written in English.
RituStudio may change these Terms at any time. The most recent version, dated below, replaces all earlier ones.
